Why Accessibility Overlays Don’t Protect You from ADA Lawsuits

Accessibility overlays are the weight-loss pills of the web industry. One script tag, one monthly fee, and you’re supposedly protected. The pitch is appealing enough that thousands of store owners have bought in. The problem is that courts, disability advocates, and even some overlay vendors’ own documentation tell a different story.

A widget that runs in the browser cannot fix the underlying code. It can try to patch things at render time — add ARIA labels to images, tweak color contrast, intercept keyboard events — but it’s working on top of a broken foundation. Screen readers don’t see the overlay’s cosmetic layer. They parse the DOM directly. If your product grid has no semantic structure, a floating toolbar with a “screen reader mode” toggle doesn’t change that.

The legal exposure is the part that surprises people. Plaintiffs in ADA lawsuits aren’t testing your site with the overlay turned on. Their lawyers use automated scanners and manual assistive technology testing against the actual HTML. Overlays have been named explicitly in lawsuits as evidence that a company was aware of its accessibility problems but chose a shortcut instead of a fix. That’s not protection — that’s a paper trail.

None of this means accessibility is impossible to automate. It means the automation has to happen at the code level, not the display level. Real fixes — proper alt text baked into the markup, semantic heading structure, keyboard-navigable components — don’t disappear when a user’s browser blocks third-party scripts. They’re just there, working.
